PLEASE NOTE THAT YOUR USE OF AND ACCESS TO OUR SERVICES (DEFINED BELOW) ARE SUBJECT TO THE FOLLOWING TERMS; IF YOU DO NOT AGREE TO ALL OF THE FOLLOWING, YOU MAY NOT USE OR ACCESS THE SERVICES IN ANY MANNER.
These Terms of Service (the "Terms") are a legal document between you ("you", "your") and Riverview Bark LLC ("Riverview Bark", "we" "our", or "us") a NJ corporation.
Riverview Bark may provide services including, but not limited to, dog daycare, boarding, and training via our website, https://www.riverviewbark.com (the "Service") to you subject to these Terms. Riverview Bark is the owner and operator of the Services. Please ensure you read these Terms carefully before using the Services. By using the Services, you explicitly agree to comply with and be bound by the Terms and all terms, policies, and guidelines incorporated and referenced herein. If you do not agree to all provisions of these Terms, immediately cease all usage of the Services.
ADDITIONAL POLICIES AND AGREEMENTS
To the extent additional rules or guidelines govern your use of these Services, those rules and guidelines (including our Privacy Policy) are hereby incorporated by reference into these Terms of Use. Our Privacy Policy describes the information we collect when you and others use our Services, as well as how we use the information, and some of the steps we take to protect your privacy. By agreeing to these Terms of Use, you are also consenting to our use of your information in accordance with our Privacy Policy.
ELIGIBILITY
You must be 18 years or older to use our dog daycare services. By using our services, you confirm that you are of legal age to enter into a contract.
RESERVATIONS
While we make our best effort to provide you with up-to-date data regarding space at Riverview Bark (or other services), availability is subject to change at any time. We make no representations or warranties regarding availability of any services. In the event of a technical or clerical error in the published rate or availability of any service, we reserve the right to cancel your reservations and provide a refund for your purchase (including after your purchase is confirmed) and you agree that such refund will be our sole liability and your sole remedy.
To book a spot for your dog for any of our services, you must provide accurate and complete information, including your dog's medical history and vaccination records. Payment for services are due prior to service date. We accept various payment methods, which will be communicated to you during the booking process and within our Terms of Service. Our cancellation and refund policy is provided in our Terms of Service. Please review and understand these terms. We reserve the right to terminate our services for any reason, including non-compliance with these Terms or disruptive behavior by your dog.
PRICING AND GRADING STRUCTURE
Your dog will be assessed and initially placed into a Star Level (1, 2, or 3) based on their behavior, socialization skills, current level of obedience, and level of attention they require.
Pricing varies between Star Levels, reflecting the personalized attention and training your dog will receive. As your dog progresses and demonstrates improvement throughout the Day Academy sessions, they have the opportunity to advance to the next Star Level. Star Levels and pricing are subject to change depending on overall progress or regression in a dog's behavior.
FEES
Payment is due in advanced for all services. Please review the below services and payment schedule associated. All payment for services must be paid by credit, online payments, or cash.
Day Academy and Training: Payment is due prior to the service date.
Boarding: Payment is due upon the date of scheduling.
You give permission for Riverview Bark to charge any credit card you provided for unpaid services or products upon the date that the services were supposed to have been completed. You also agree to pay any collections costs and the cost of any returned or challenged debit charges.
CANCELLATIONS, RESCHEDULING, AND REFUND POLICY
For Day Academy, we require a minimum 24 hours notice for any cancellations/rescheduling.
For Boarding and Training services, we require a minimum 48 hours notice for all cancellations/rescheduling.
Please check your specific reservation for the exact notice period required. Cancellations made within the stipulated notice period will be eligible for a full refund of the daycare, boarding, or training fee. Cancellations made after this period may result in forfeiture of the service fee. In the event of a verifiable emergency or unavoidable circumstances, exceptions to our cancellation policy may be made. Please contact us as soon as possible to discuss such situations.
For rescheduling, dates are subject to availability. We will make every effort to accommodate your preferred new dates, but we cannot guarantee availability during peak periods. Rescheduling within the required notice period does not incur any additional charges. However, rescheduling with less notice may result in additional fees.
No-shows: Failure to show up/check in your dog on the scheduled service date without prior notice may result in forfeiture of the service fee.
For Day Academy and Boarding, if you need to extend or shorten your dog's stay while they are with us, please notify us as soon as possible. Additional charges may apply for extended stays, and refunds may be issued for shortened stays, subject to our policy.
All cancellations, rescheduling requests, and changes to your dog's boarding reservation must be made online or by contacting our facility directly.
HOLIDAY/PEAK DATES CANCELLATIONS
If the client fails to follow through with the reservation made for any holiday or peak dates stay with at least a 72 hour notice, the client will be charged for the entire stay reserved - no exceptions.
ACCEPTANCE AND ACKNOWLEDGEMENT OF RISK
You fully understand that there are inherent and potential risks involved with dog services, including interactions between humans and dogs, as well as between dogs and other dogs, which may result in property damage or bodily injury, including but not limited to, permanent disability, sickness or death to human or dog. You accept and assume all risks and responsibility for all risks, including all losses, costs and damages as a result of your dog’s participation at a Riverview Bark.
RELEASE AND INDEMNIFICATION
You hereby release from liability, waive, discharge claims, indemnify, hold harmless and defend Riverview Bark, its employees, owners, volunteers, contractors, representatives, agents, and any others with an interest in any Riverview Bark party (collectively, the “Releasees”) from any liability arising from your dog's participation in any of the services, including but not limited to injury, liability, claims, litigation, actions, suits, costs, losses, damages, attorney’s fees, expenses or demands on account of, arising out of, resulting from any act of omission of the Releasees.
THIRD-PARTY AND AFFILIATE DIGITAL SERVICES
Certain areas of the Digital Services and some payment processing functions, may be operated on behalf of Riverview Bark by third parties, and our Digital Services may include links to third party sites or services which may be subject to the Terms of Use and/or Privacy Policies of those parties. Riverview Bark is not responsible for any aspect of these third-party service providers, their services or websites. Please review any terms and conditions that may apply if and when you visit any third party sites or use any third party services available through our services.
USER-SUBMITTED CONTENT AND USER CONDUCT
Any content, whether uploaded, posted, submitted, or otherwise made available on our Digital Services or to Riverview Bark, including without limitation comments to blog posts, user content from social media, or any other content which does not originate with a Riverview Bark Party (“User Content”), is the sole responsibility of the person who made such User Content available. Under no circumstances will any Riverview Bark Party be liable in any way for any User Content made available through any of our Digital Services. We may not moderate all comments or other User Content, so we cannot and do not warrant and/or guarantee the truthfulness, integrity, suitability, or quality of any User Content.
You agree that you will not use any of our Digital Services to store, transmit or make available any content that:
violates any laws, contains any threats, is abusive, harassing, vulgar, obscene, indecent, violates any person's rights of privacy or publicity, is defamatory, libelous, hateful, contains any disparaging statements or opinions regarding racial, gender or ethnic background, or is otherwise tortious or objectionable;
infringes any intellectual property rights or other rights of any party, including, but not limited to any patent, trademark, trade secret, copyright or other proprietary rights;
contains any private information about an identifiable person without that person's permission, or any content soliciting any personal or private information from any individual;
you know or have reason to know or ought to know is false, misleading, or fraudulent;
you do not have a right to make available under any law or under contractual or fiduciary relationships;
employs any techniques to disguise the origin of the content submitted;
contains any unsolicited or unauthorized advertising or promotional materials;
incorporates within it any software viruses or any other malicious code;
contains links to any websites containing content violating any of the foregoing requirements, the law, or other provisions of these Terms of Use.
You further agree not to use our Digital Services to:
engage in any conduct which might be harmful to any individual;
impersonate or misrepresent your affiliation with any person or entity;
engage in or facilitate any conduct that is deemed, or found by any court or similar agency, to constitute "stalking" or otherwise harassing conduct aimed at another person or entity;
engage in or transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, provincial, national, or international law or regulation.
In addition, you are prohibited from interfering with, creating an excessive burden on, or otherwise disrupting our Digital Services, servers or networks connected thereto. We reserve the right (but have no obligation) in our sole discretion to pre-screen, edit, refuse, move or remove any User Content that is posted on our Digital Services or prohibit your access to our Digital Services in the event of a violation of these Terms of Use.
If any User Content is your original work, then you own the copyright in that work. However, by uploading, posting, transmitting or otherwise making any User Content available on or through a Digital Service or social media, you are granting Riverview Bark, and our related entities, an irrevocable, nonexclusive, royalty-free license to copy, modify, publish, distribute publicly, and prepare derivative works of such User Content in any medium or format without any obligation of notice, attribution or compensation to you.
COPYRIGHT AND TRADEMARK INFORMATION
All content, copyrights and other intellectual property rights in the content available on our Digital Services, including without limitation Digital Services design, text, graphics, interfaces, and the selection and arrangements thereof, are owned by Riverview Bark, with all rights reserved, or in some cases may be licensed to Riverview Bark by third parties. This content is protected by the intellectual property rights of Riverview Bark or those owners. All trademarks displayed on the Digital Services are the trademarks of their respective owners, and constitute neither an endorsement nor a recommendation of such parties.
CHANGES TO TERMS
We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Terms on this page.
We will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective and update the "effective date" at the top of this Terms of Service.
You are advised to review this Terms of Service periodically for any changes. Changes to this Terms of Service are effective when they are posted on this page.
